Subject: Novel Coronavirus Disease (COVID-19)-Declaration of force majeure event by Gateway Rail Freight Limited (GatewayRail) with effect from 25th March 2020.
The world wide outbreak of Novel Coronavirus and the resultant Coronovirus Disease COVID-19 has resulted into the World Health Organization (WHO) declaring it as a "Global Pandemic". In view of this development, Govt. of India expressing through the Hon’ble Prime Minister, has declared a nationwide lockdown putting severe restrictions on mobility of men and material for an initial period from 25th March 2020 to 14th April 2020. As a consequence, the State Governments and the District Administrations have taken drastic measures to restrain / restrict movement of people and cargo which has stalled / severally impacted rail and road transportation and other services at the maritime ports, Container Freight Stations (CFS) and Inland Container Depots (ICD). As a good corporate citizen, we are bound by and fully acknowledge & support these measures taken by various government authorities. Under such circumstances, we are working with extremely limited staff and resources at our Terminals and are constrained to notify that under these circumstances, Gateway Rail Freight Ltd. (GatewayRail) may not be able to perform any or all of its obligations as per the terms and conditions of various commercial and other contracts and agreements with various entities entirely due to reasons beyond their control.
Therefore, Gateway Rail Freight Ltd. hereby notifies "Force Majeure Event" starting with effect from 25th March 2020
GatewayRail shall not be responsible for any claims, damages, charges etc. whatsoever arising out of and or connected to the force majeure event, either directly or indirectly, without any limitation, pertaining to receiving, handling, storing, transporting and/or delivering cargo and containers at various maritime ports, Container Freight Stations (CFS) and Inland Container Depots (ICD). Further, we wish to notify that GatewayRail will not be responsible for any direct or indirect losses whatsoever including any damage to any containers or any cargo or any goods offered for handling, transportation, storage etc. to GatewayRail at any port, intermodal terminal or warehouse by any party or any other related entity in the multi-modal chain and any claims, damages, charges etc. arising out of such damage whether directly or otherwise during the force majeure event period.
We will notify the end date of force majeure event, once normalcy is restored.
